HOV lane

The Aptera web site indicates that the Typ-1 will be able to use the HOV lanes.
However, it appears that there was a law change (late in 2007) that appears to prohibit a "large", enclosed, 3-wheeled motorcycle (like the Typ-1e or 1h) from any use of the HOV lanes, no matter how many occupants.
As of May 2008, a bill is going through the California legislature that would delete the prohibition on fully enclosed three-wheeled motor vehicles using the HOV lane. The bill is AB 2272 (Fuentes). [1]
Apparently it is thought by some that the Typ-1e will be able to use California's HOV lanes without a PZEV sticker, but that the Typ-1h will not [2] ... but this is possibly just a mistaken impression.
